Competition law in the UK is enforced in one of two ways. Public enforcement involves investigations by public bodies, principally the Competition and Markets Authority (CMA) and – before Brexit – the European Commission (EC). Investigations can be civil or criminal in nature and the CMA has the power to levy substantial fines against a company that infringes competition law.

The criminal cartel offence applies to an individual who agrees to create or participate in arrangements involving price fixing, market/customer sharing, bid-rigging or output limitation (cartel behaviour). Individuals found guilty of an offence can face imprisonment, unlimited financial penalties and disqualification as director.

Private enforcement refers to actions for damages taken by companies or individuals who suffer a loss as a result of breaches of competition law.  These claims can either follow a decision of the EC or CMA (known as “follow-on” claims) or be independent of such an investigation (“stand-alone” claims).

Individuals convicted of murder automatically face a mandatory life sentence, and in the most severe instances, may never be eligible for release. Regardless of the nature of the case, whether under investigation or charged with murder, Salhan Dharna Law commits to exhaustive analysis of evidence and exploration of available options to secure the most favourable outcome for the client. Manslaughter cases are a recurrent focus for our representation. Allegations often involve unlawful killing due to diminished responsibility or the absence of intent to cause harm. Diminished responsibility cases hinge on expert psychiatric evidence challenging the prosecution's claims, addressing instances where the defendant experienced psychiatric or psychotic episodes during the offense.

The wide spectrum of assault offences ranges from more minor offences such as common assault to the most serious offences such as attempted murder and causing grievous bodily harm with intent. This spectrum was extended 2022 by the introduction of the two new assault offences of non-fatal suffocation and non-fatal strangulation.

Many solicitors have little experience of the most serious assault offences which often involve gangs and organised crime groups. Also, there is often a fine line between degrees of assault, although the difference in sentencing range can be marked. This makes it very important for those faced with assault charges to obtain the best possible legal advice from an experienced lawyer early on.
